Discussing Grandparent Custody For Those Who Need It

By Susan Snyder

For the grandparents who are fighting to keep their grandchildren, or at least hope to see them every now and then, good luck. That is not easy to do. The court only determines the mother and father most of the time so unless you got enough proof that you are able to do it and they could not, you might have a very big hurdle to go through. Especially when the law mostly recognizes the dad and mom to be with their kids. In this age, it has only gotten tougher. Even if the parents are going through a rough time of separation, granddads and grandmas are going to have to struggle. Pay attention. You need Grandparent Custody Durham NC.

Some states in America actually do not give enough for the grandparents. They give these parents the strongest power over who gets to be with their children in their best interest. They can even prevent these older people from ever seeing the kids, as long as both parents agree to it. If they want the right to visit, they will have to seek mediation with said parental figures.

Only in certain situations will you get to keep the little fellas. Like if you have actually lived with them for more than a year. Or maybe their parents consent to it. Or if they have been labeled as unfit to be taking any children in at all. Most especially though, you may get the kids if their mom and dad have died.

You heard that there are certain cases that this might be easy. Like, if your son and his wife died, which is horrible to even think about because he is still your son. Then if they actually agree to it. Also if the proof was enough for the court. You were hoping for the last one because there is no way in hell you are letting your grandkids suffer anymore.

And even then, assuming that both of them, these parents that is, are really unfit to care for kids, there might be a chance you will fight other relatives. This may lead to a messy showdown. You might not be put into account unless you fight a strong case.

Work on settling any form of disputes you got with the parents. Have them be in your favor before anything legal happens. Get a neutral party to see your point and avoid any messy outcomes. If that does not work, you can get a petition for your right.

If the good thing happens, you might at least get to have visitations. Though, you will need a specific time and date to do that now. Some states do allow that so no need to worry.

In another spectrum, which is the bad side, there are states that restrict such visits. If you live in these such states, you may have trouble keeping your right since they really prioritize the relationship between the parent and the child first.

But, if everything works in your favor and you proved you are way better than the alternative, you can get the kids. Make sure the court sees your point. They will always prioritize kids more than anything.
