It is a sad fact that more and more marriages fail. When this happens, there are always people that are hurt, especially if there are children involved. When hate, spite and meanness drive couples to court for a ruling when they separate they often do not fully appreciate the potential consequences. There are numerous issues involved when a couple separates. The entire process can be stressful, expensive and time consuming. Mediation can only succeed if both parties are willing to be reasonable and willing to discuss matters objectively. If one party has been the victim of abuse, feels intimidated or is unwilling to subject to mediation the process cannot work. In such cases the mediator will probably recommend that the case proceed to court for a formal ruling and the couple will have to face the trauma of a public display.

Separating couples can save much money and time if they discuss major issues and reach some form of agreement on those issues before submitting to mediation. The mediator will then be able to simply review the informal agreements and concentrate on those issues that were not discussed or agreed upon. Major issues such as custody and maintenance are often agreed upon in private discussions between the two parties involved.

The final product of the mediation process is a legal document that contains all the various decisions and agreements that the couple reached. This document is submitted to a judge who will normally declare it as a court order and who will issue a divorce decree at the same time. The parties involved normally do not even have to appear in court.

Most people never contemplate a separation when they marry. Yet, it is a fact that marriages fall apart. When this happens, the best course of action is to try and keep the matter private and to dissolve the union with the minimum of fuss and cost. A contested separation can be embarrassing and very expensive.
